Memories in an Instant Photobooth Hire

Terms and Conditions

Privacy

"Memories in an Instant" (the Hirer) will not give, sell or otherwise allow your details to be disclosed to any third party and will take reasonable measures to ensure that your details remain confidential.

Travel and Parking

Delivery and setup of the Photobooth is included in the cost of hire except where:

The distance to the venue is greater than 30km
The time taken to get to the venue is greater than 1 hour in normal traffic

In these cases, a fee with be charged and communicated at time of booking

Where the travel distance is greater than 50km a hire of no less than 4 hours is required.

Parking for delivery, pickup and duration of the hire at the venue must be arranged by the hiree, unless free parking is available at all time. In the event "Memories in an Instant" incurs parking fees these will be passed on to the hiree at cost.

Payment

A deposit equal to 50% of the booking fee (based on length of the booking time) is necessary to secure the event time and date and guarantee the price. Prices may change please confirm price before booking. By paying the deposit the hiree is also agreeing to these Terms & Conditions. Until a deposit is received, the date cannot be confirmed. All outstanding amounts must be paid by the hiree to "Memories in an Instant" (the Hirer) at least 14 days before the event. If booked within 14 days of the event, full payment must be made at time of booking and is not refundable. A travel charge may apply to events outside Memories-in-an-Instant’s normal area of business – this charge if any will be disclosed at time of booking. Any waiting time in excess of 30 minutes may attract a fee, charged at $55.00 per hour or part thereof. Public Holidays and some other dates may incur additional charges. All fancy-dress props (if used) must be returned to the hirer and must be in good condition at the end of the event, otherwise charges may apply.

GST

All prices are inclusive of GST.

Cancellation

Cancellations more than 30 days before the booked date will incur a fee equal to 50% of the deposit amount, cancellations within 30 days of the booked date will incur a fee equal to 100% of the deposit amount. If the hiree cancels between 30 days and 7 days before the booked date, at the sole discretion "Memories in an Instant", the deposit can be held over for a future booking – such booking must be within 6 months of the original booking date. Prior notice is required of changes to the time and date of the event. "Memories in an Instant" cannot be held responsible for unforeseen delays at the venue.

Delivery and ongoing support during the hire period

Delivery and setup of the Photobooth will take place before the commencement of the hire period and dismantling and removal will take place after the end of the hire period.

The Photobooth attendant will be in the venue at all times during the hire period and will be contactable by mobile phone (number provided to the hiree before the start of the hire period) if not at the booth. In the event that the venue requires the booth to be set up more than 1 hour prior to the commencement of the hire period, "Memories in an instant" must be notified no less than 3 days prior to the event date and a waiting time fee may apply.

The Hiree will be liable for any damaged caused to any of the equipment included in the hire during the hire period.

There is no charge for the setup and removal of the equipment.

Use of images

The hiree grants "Memories in an Instant", permission for images taken at the event to be used on "Memories in an Instant’s" website and for advertising purposes, except for images of minors where permission will be sought on a case by case basis. Unless advised prior to the event that they would not like their images used. "Memories in an Instant" will not use any images that are unsavoury or that may be embarrassing or damaging to any person or persons.

Force majeure

"Memories in an Instant" or any of its employees will not be liable for failing to perform under the Agreement by the occurrence of any event beyond our reasonable control, including a labour disturbance, Internet outage or interruption of service, communication outage failure by a service provided to us to perform, fire, threatened or actual act of terrorism, natural disaster, or war.

Miscellaneous

If in the opinion of the "Memories in an instant" attendant the equipment is being mistreated, misused or used in any way that is dangerous or harmful to any person or persons or the equipment itself, the attendant may stop the usage of the equipment until such time as the situation that caused the attendant to stop the usage is rectified to the attendants’ satisfaction, if the situation is not rectified the attendant will not restart the equipment.

Any variations to these Terms & Conditions must be agreed to in writing by "Memories in an Instant".
